The St. Regis Lawsuit asserts that Starwood, St. Regis and Vistana have breached their duties to the owners and crushed the value of units of fractional interests at the Fifth and Fifty-Fifth Residence Club or St. Regis Residence Club. The wrongful conduct alleged has destroyed the viability of the St. Regis Residence Club. Matt Ferguson’s clients seek damages including the significant diminution in value of their St Regis Club Interests caused by Defendants’ breaches and other unlawful acts, as well as the disgorgement of all monies Defendants have unjustly pocketed. Many of the Plaintiffs represented by Aspen attorney Matt Ferguson seek rescission pursuant to a contractual right of rescission of the purchase contracts.
